The factors behind many of the accidents between cars and emergency vehicles overlap with many of the common causes of motor vehicle accidents. For example, motorist or emergency vehicle driver error (e.g., inattention, sleepiness, overly aggressive driving, or failure to obey traffic signals), road or weather hazards (e.g., road obstructions, slick roads, or poor visibility) and faulty traffic flow devices (e.g., unclear road signs or defective traffic lights) can lead to auto accidents. Another common cause is the failure of motorists to yield to oncoming emergency vehicles.
If you have been injured in an accident with an emergency vehicle, contact Proner & Proner to schedule a consultation with one of our Bronx emergency vehicle accident attorneys. We represent clients in New York City and throughout NY’s five boroughs.
Proving liability in cases involving an accident between a car and an emergency vehicle can be complicated. While motorists are required to yield to oncoming emergency vehicles (if those vehicles announce their approach with sirens), a motorist’s failure to yield does not guarantee that they will be held responsible for an accident. Rather, the circumstances surrounding the accident will largely determine liability. For example, if the driver of an emergency vehicle fails to give sufficient warning of the vehicle’s approach and an accident results, the emergency vehicle driver could be held liable. Alternatively, if a car and an emergency vehicle collide due to defective traffic flow monitoring devices, the city (or the party responsible for maintaining those devices) can be held liable.
Finally, the law does not condone over-aggressive driving by emergency vehicle drivers. Although these drivers are authorized to drive assertively and to exceed the speed limit in certain circumstances, they must remain within certain parameters. When emergency vehicle drivers fail to stay within these parameters and an accident or injury occurs, the emergency vehicle driver can be held liable.
An emergency vehicle driver’s failure to adhere to certain guidelines could impact their defense against a motor vehicle accident lawsuit. In many states, the law requires that emergency vehicle drivers:
