What laws might affect my NYC construction accident case?

The construction industry is highly regulated by OSHA and federal safety laws. New York also has some of the strongest legal protections for construction workers in the nation.

New York Labor Law 240

New York’s scaffolding law has two primary functions. It requires site owners and contractors to provide fall protections for construction laborers who work on scaffolding, ladders, hoists, and other above-ground areas. It also provides certain legal protections to workers who are struck by falling objects and work materials.

New York Labor Law 241

Section 241 of New York’s Labor Law requires employers engaged in construction, excavation, and demolition work to “provide reasonable and adequate protection and safety” for their workers. This can include providing necessary personal safety equipment and installing barriers around fall hazards.

New York Labor Law 200

Labor Law Section 200 instills a general duty for employers and contractors to provide a safe work environment for workers. Under the law, workers can seek financial compensation if they are hurt in an accident involving a dangerous piece of equipment or hazardous working conditions on the job site.

How long do I have to file a claim after my NYC construction accident?

It depends on the type of claim you file. For workers’ compensation benefits, you must notify your employer of your injury within 30 days of getting hurt (or having an injury or occupational disease diagnosed). Then you’ll have two years to file a formal workers’ compensation claim.

If you have the opportunity to file a civil construction accident lawsuit, New York law gives you three years from the date of your accident.
