Polluted Brooklyn Waterway Becomes Even More Polluted

A reckless driver fled the scene of a crash and drove directly into the toxic waters of the Gowanus Canal.
After he struck a Toyota Camry at the intersection of Degraw and Court in Cobble Hill, witnesses state that Matthew Murphy did not even attempt to stop his Audi before it toppled into the waterway that is known as a dumping ground for raw sewage and factory waste. Onlooker Maurice Deas, who pulled Mr. Murphy away from the water’s edge and back onto solid ground, said the driver appeared incoherent and disoriented. “He just kept saying he was an Iraqi War veteran,” said Mr. Deas. The 47-year old woman in the Camry, whose name was not released, was transported to a local hospital, along with her uninjured 1-year-old daughter.
Mr. Murphy was arrested and charged with reckless endangerment and leaving the scene of a collision.
Hit and Run Crashes
Actual numbers vary significantly, but generally speaking, around 50 percent of hit-and-run drivers are apprehended; this apprehension generally takes place in the moments or hours following the crash. But victims can still receive compensation, whether or not the driver is caught.

If a settlement cannot be reached, the matter typically goes to arbitration instead of trial, because a lawsuit is usually prohibited by the insurance agreement.
