Multi-Car Crash Causes Multiple Injuries

A 14-car pileup on an icy stretch of the Bronx River Parkway sent 10 people to the hospital with various injuries.
The wreck, which was actually a cluster of four smaller collisions, took place on the Parkway’s southbound side near the Sprain Brook Parkway merger. Several drivers reported seeing the blockage ahead, but claimed they were unable to stop on the slick road. In one of the worst collisions, one SUV was left dangling off the road’s edge and another SUV had its entire front end smashed in.
The stretch of roadway finally reopened about 24 hours after the crash, once authorities removed the wrecked vehicles and made repairs to guardrails.
Breach in a Negligence Case
In the second component of a negligence case, the plaintiff must show, by a preponderance of the evidence, that the defendant somehow failed to fulfil the duty of care. Broadly speaking, a legal breach typically falls into one of three categories.
An environmental breach occurs when drivers fail to adjust to driving conditions, as was the case in the above story. If the road is slick due to ice, snow, rain, or some other foreign substance, the duty of reasonable care means that drivers must slow down and maneuver as little as possible. So, if there are adverse environmental conditions, drivers who are travelling at or near the speed limit can still cause a speed-related car crash, if they did not slow down enough.
Other breaches are behavioral. Before they get behind the wheel, drivers must not consume alcohol or drugs, take prescription painkillers or other similar medicine, get plenty of rest, and not have a medical condition that could cause a loss of consciousness.
Finally, there are conditional breaches, like running a stop sign or exceeding the speed limit. These driving habits typically constitute negligence per se, meaning that it is easier to prove the remaining elements.
