A Deadly Day Throughout NYC

Police are investigating three fatal hit-and-run pedestrian crashes that took place in separate parts of the city in approximately a three-hour period.
At about 1:40 a.m. on February 29, a black SUV struck and killed 63-year-old Jose Contreras while he was walking across Webster Ave. near the Cross Bronx Expressway. Then, at about 4:40 a.m., a 41-year-old pedestrian, whose name was not released, was struck and killed in Park Slope near the intersection of Fifth Avenue and Ninth Street. At about that same time, 48-year-old Besik Shengelia, of Sheepshead Bay, was fatally struck on 111th Street near 109th Avenue as he retrieved personal belongings from his car. None of the drivers have been identified or apprehended so far.
Also over Leap Day Weekend, a 33-year-old pedestrian was hit and killed in the Bronx, and a 22-year-old pedestrian in Jamaica was rushed to the hospital in critical condition after being hit by a minivan.
Hit and Run Crashes
Whether the drivers are caught or not, and the cases run basically 50-50 as to either outcome, there are legal options for hit-and-run victims in New York.
If the driver is not caught right away, there is generally a two-year statute of limitation in these cases, which means there is plenty of time for a private investigator to locate the driver. This can be done by following up on leads that first responders often do not pursue, because they are on scene to tend to injured victims and not build a case for the plaintiff. In court, the plaintiff need only prove liability by a preponderance of the evidence, which means more likely than not.
If the driver is not identified before the statute of limitations runs out, injured victims may filed claims against their own insurance policies. The procedure is similar to the one used in non-serious accidents.
If the driver is identified, the jury often awards punitive damages, because most people are eager to punish hit-and-run drivers. These damages are in addition to the compensatory damages awarded for economic and noneconomic losses.
