Kew Gardens, Queens, NY Construction Accident Lawyer

Highly-Experienced Attorneys Advocate For The Rights And Interests Of Clients Injured In Kew Gardens, Queens, Construction Accidents

Whenever people drive by the hilly terrains or walk around the garden community of Kew Gardens, and they see a fenced excavation or scaffolding works, oftentimes they give very little attention to what’s going on. They hardly even notice for how long the construction fence had already been there or when they were taken out. But it is an established fact based on statistical studies that construction sites are among the most risky and dangerous places to work in America. A construction site is a maze of a slippery pile of debris, a tilting ladder, a protruding wedge, a loose chain saw link, or an exposed live wire just waiting to happen as an accident.

At Proner & Proner, our Kew Gardens construction accident lawyers will help you pursue and recover compensation for injuries and damages you sustained regardless of the circumstances of your construction accident. If you are a construction worker who was injured on the job, our firm can guide you through the whole process of filing a workers’ compensation benefits claim. We’ll work to make sure that your employer pays all the benefits you are entitled to, including medical benefits and disability payments. However, we do understand that often this is not enough to cover your medical treatment expenses let alone your family’s living expenses especially after the accident happened.

It would be a bit different though if you were injured due to the negligence, carelessness or recklessness of a third party, or when the accident was due to defective machinery, equipment, or materials; in which case we’ll help you pursue a personal injury claim to recover compensation that is not included among the workers’ compensation benefits. But if you were just an innocent passerby or bystander, then we’ll have to pursue a personal injury claim against all those persons liable for what happened to you such as the construction company or the property owner.

About Kew Gardens, Queens, New York

Kew Gardens is a neighborhood in the central area of the New York borough of Queens. The whole area of Kew Gardens is roughly shaped like a triangle. On the north, it is bounded by the Union Turnpike and the Jackie Robinson Parkway (formerly called the Interboro Parkway). To the south, it is bounded by Hillside Avenue. To the west, it is bounded by Park Lane, Abington Road, and to the East by the Van Wyck Expressway.

Kew Gardens was one of seven planned garden communities built in Queens from the late 19th century to the 1950s. In 1868, a huge portion of the area was acquired by the Englishman, Albon P. Man. He developed the neighborhood Hollis Hill in the south, mainly along Jamaica Avenue, but he left the hilly land to the north undeveloped.

In 1875, Maple Grove Cemetery was opened on Kew Gardens Road. A Long Island Rail Station was built for mourners in October. The station was named Hopedale. This was taken from the hotel named Hopedale Hall, which was located at what is now Queens Boulevard and Union Turnpike.

Frequently-Asked Questions About Construction Accidents In Kew Gardens, Queens

FAQ: If I was a construction worker injured on the job, can I still claim compensation even if I was being paid “off the books”?

Yes. Even if you are a worker who is paid “off the books”, we may still be able to help you claim workers’ compensation benefits. To do this, we need only to establish that you are an eligible employee. Whenever it is more appropriate, we can also help you recover financial compensation through third party personal injury claims like negligence or product liability claims.

FAQ2: Does my immigration status affect my ability to pursue compensation for injuries which I suffered during a construction accident?

No. Your immigration status doesn’t matter when you pursue financial recovery if you were injured in a construction accident. It has no effect on your right to seek financial compensation from the persons liable for your injuries in a construction accident. Whenever appropriate, we can also help you file a claim for workers’ compensation benefits, and pursue other personal injury or product liability claims from third persons to obtain compensation for your injuries and damages from a construction accident.
