New York Law Protects Scaffolding Accident Victims
The general character of NYC—condensed, highly populated—makes scaffolding much more prominent here than in other cities. New York labor laws have been amended to provide protection for workers injured in scaffolding accidents. Under New York Labor Code Section 240:
- Construction site owners and general contractors must ensure scaffolding is properly constructed,
- You must be given safety equipment necessary to use the scaffolding safely.
This law generally makes it easier for scaffolding accident victims to recover compensation. Property owners and general contractors can be held strictly liable for your injuries under Section 240—whether you fell from the scaffolding or the scaffolding itself fell or collapsed. Section 240 applies regardless of whether your work accident involved:
- Mobile scaffolds
- Tubular steel scaffolding
- Baker scaffolds
- Wood scaffolding
- Pole scaffolds
Section 240 can also apply if you’ve been injured in a crane accident, forklift accident or other type of construction accident involving work from heights.
Our labor accident lawyers are here to make sure you understand all options for recovering compensation for your injuries. Potential recovery options may include:
Under which you receive benefits but cannot sue your employer,
lawsuit if the scaffolding accident resulted in the death of your loved one.
lawsuit against a negligent third party, such as a property owner, engineer, architect or other individual responsible for the scaffolding safety,

Frequently Asked Questions About Scaffolding Accident Claims In New York
The primary difference between the two recovery options is the type of compensation available. Workers’ compensation usually only covers medical expenses, a portion of your lost wages and wrongful death compensation. Under Labor Law 240, you also have the right to recover compensation for emotional distress and pain and suffering after a scaffolding accident.
Although New York imposes a three-year limit on filing a personal injury lawsuit and a two-year limit on wrongful death claims, work accidents are subject to additional timing rules. You must notify your supervisor of the accident as soon as possible—but generally within 30 days—of the scaffolding accident. After you provide this notice, you have a one-year period to file for workers’ compensation. There’s also a seven-day waiting period before you can receive workers’ compensation benefits. Once seven days have passed, you receive benefits from day one (retroactively).
