Is Uber Responsible When an Uber Driver Hits and Runs Over a Pedestrian?

If a driver for Uber is involved in an accident where that driver hits and runs over a pedestrian, knowing if the driver or Uber is responsible is important because it has an impact on the amount of compensation a victim can receive for his or her injuries. A victim needs to know who will be held responsible for their injuries. The responsibility of the driver will depend upon the situation and how things played out on the day of the accident.

When Is Uber Liable for a Pedestrian Accident?

Even if someone works for Uber, the company is not responsible for an accident when the driver of that vehicle was not working for Uber at that exact moment. At-Fault Drivers

If the driver of the Uber vehicle was at fault, there are usually several ways to prove this. There are often witnesses from other vehicles that see accidents as they happen. Some witnesses are pedestrians that are walking on the sidewalk in a neighborhood when the accident initially happens. In addition to collecting information from witnesses that would point toward the Uber driver being in the wrong, footage from surveillance cameras and cell phones could also be used to prove negligence on behalf of that driver. If there is a lot of evidence that proves the driver for Uber was the one who caused the accident, Uber may then attempt to reach a settlement with the victim to provide them with compensation for what they have been through. If the settlement amount being offered is fair, the victim may agree to settle instead of taking things to the courtroom.

Proving Liability

Even when the driver is at fault, the victim must still work with the attorney to prove that the driver was negligent in some way and that his or her negligence caused the injuries that the victim sustained. There are different ways to prove this by providing medical records, surveillance footage, images of the vehicles involved, and even getting assistance from expert witnesses that can recreate the accident scene.
