Victim of NYC Construction Crane Accident Files $30 Million Lawsuit

A man who was severely injured by a falling crane at a New York City construction site has informed the city that he intends to file a $30 million lawsuit against the NYC Department of Buildings. Thomas O’Brien, who is 73 years old, suffered a fractured spine and skull when a crane fell on his car. The vehicle was parked on Worth Street in Manhattan.
O’Brien was sitting in his car waiting for his daughter to complete a doctor’s appointment when the construction crane crashed onto his car’s roof. O’Brien, who is from North Easton, Massachusetts, alleges that the city was negligent, reckless and careless in its supervision of the construction site. As a result of the accident, one man died, while three people, including O’Brien, were seriously injured. David Wichs, 38 years old at the time of the accident, was killed when the boom collapsed onto him while he walked to work.
According to O’Brien’s attorney, O’Brien is undergoing evaluations to determine whether he suffered traumatic brain injury. Moreover, O’Brien may require surgery on his spine, which suffered two fractures. Prior to the accident, O’Brien was in great physical shape and rode dirt bikes.
The lawsuit states that the NYC Department of Buildings was at fault for the construction accident because the agency receives weather reports on a regular basis. Prior to the accident, the agency was reportedly aware that there would probably be strong winds on February 5, the date of the construction incident.
Workers who witnessed the construction accident said that the crane plummeted when a strong gust of wind blew it around while it was being lowered. O’Brien’s attorney contends that the contractors and the city had a duty to lower the crane before the winds became stronger and that they should have cleared the streets of pedestrians and motorists prior to moving the crane.
