Jackson Heights is a neighborhood of the New York City borough of Queens. Present-day Jackson Heights was built on a vast marshland called Train Meadows. In 1909, the Queensboro Corporation bought the land during the New York City housing shortage to build a planned development for middle and upper-middle income families moving out of the crowded neighborhoods in Manhattan. Jackson Heights was named for John C. Jackson, a respected local entrepreneur, and descendant of one of the original Queens families. The development of Jackson Heights continued through the post-World War II boom. In the 1960s, the community began to take on a more ethnically diverse character with new arriving professional families from Latin America and the Indian Subcontinent. By the 1990s, the residents of Jackson Heights were successful in petitioning to have Jackson Heights designated as a historic district. Today, Jackson Heights is still an attractive destination for middle and upper-middle income families due to the neighborhood’s diversity and architecture.
Even though you may simply want to settle your personal injury claim and move on with your life, before you agree to a settlement with the insurance company, it is critical that you first speak with an attorney. An experienced personal injury lawyer can review your case and advise you as to whether the settlement offer you received represents fair and full compensation for your damages. An attorney can also potentially negotiate with the insurance company to get you an even larger settlement.
Generally speaking, under New York’s statute of limitations for personal injury claims, you have three years from the date of your injury to file a lawsuit to recover compensation. Under certain circumstances, this three-year period can be extended, or “tolled”, such as if you are under the age of 18 or if you don’t know (and would not discover with a reasonable investigation) of the facts and circumstances underpinning your personal injury claim. If you don’t file your lawsuit before the expiration of the statute of limitations in your case, the court can permanently dismiss your lawsuit.
