Husband left mourning wife’s unexplained death following child’s birth

Choosing to have a child is a big step in any relationship and while times can get hard, the result is nothing less than amazing. The miracle of childbirth is always something to be celebrated and regardless of what is to come in the future, not much tops bringing a new life into the world.

Unfortunately though, childbirth can have its downsides, as was the case with a woman who gave birth to her second child last September.

The woman and her husband survived the first speed bump when their second born came early. The mother went into labor prematurely and ended up having the baby at her home.

Emergency responders arrived and then brought the mother to the hospital. The couple was overjoyed with their newborn, despite the premature birth, and even managed to take photos before the mother got to the hospital.

Even more unfortunate, the situation got much worse. Following a series of surgical procedures at the hospital, the mother bled to death. She was pronounced dead less than 12 hours after giving birth. As the husband now cares for the newborn and their other child, he is left wondering what exactly happened to his wife.

Two months following her death, the husband still had yet to see an autopsy, which was still pending at New York City’s medical examiner’s office.

The husband’s next step was to take legal action, which he did. Lawyers filed a notice of claim against the hospital and more than half-a-dozen doctors who were involved with treating his wife, alleging medical negligence and medical malpractice.

While medical malpractice is not always intentional, it is still something that occurs far too often. Doctors and other medical professionals can be overworked due to the demands of the job and that combination can unfortunately lead to mistakes. When mistakes happen, patients can suffer.

If you or a loved one suffered due to medical negligence or malpractice you should seek a lawyer immediately. Medical malpractice lawsuits are not only involved, but also arduous to prove.

In order to show that an injury or a death was the result of malpractice, you must prove the following three things:

  • Breach of accepted standard of care – this means proving the doctor made a mistake not common or expected of a competent medical professional
  • Definitive cause of injury or death – must prove that the mistake directly led to the injury or death
  • Demonstrable damages – this means showing the damages that stemmed from the malpractice like increased medical bills, pain and suffering, lost wages, etc.

On top of dealing with the actual loss or injury of a loved one, handling a medical malpractice lawsuit on your own is quite the load. The lawyers at Proner & Proner in New York are experienced with medical malpractice suits and are ready to help you get through your difficult time.
