A former Linden NJ police officer who seriously injured in a wrong-way crash in which his fellow officer was allegedly driving while intoxicated has filed a lawsuit against the two bars accused of serving the men alcohol. The family of one of the men who perished in the car crash is also filing suit.
The attorneys for the survivor of the crash, 25-year-old Patrik Kudlac, and the family of Joseph Rodriguez, who was 28 years old when he was killed in the crash, have filed “dram shop” complaints against both bars. These legal complaints allege that the bartenders were reckless when they served Pedro Abad an excessive amount of alcohol while Abad was clearly inebriated.
The car accident occurred on March 20, 2015, just prior to 5:00 a.m. According to police, Abad was driving his Honda Civic in the wrong direction on the West Shore Expressway when he was involved in a head-on collision with a tractor-trailer. Prior to the crash, Abad reportedly went to Central Park, a bar in Roselle NJ, and Curves, a strip club in Staten Island NY. At the time of the fatal car crash, Abad’s blood alcohol content (BAC) was reportedly three times the legal limit of .08 percent. Another Linden police officer, 28-year-old Frank Viggiano, died in the DWI crash.
Abad has been charged with aggravated vehicular homicide and manslaughter, to which he pleaded not guilty. However, Abad’s attorney has put forth the possibility that the dancers at Curves drugged Abad prior to the fatal auto accident. Meanwhile, Kudlac’s lawyer stated that the New Jersey and New York dram shop laws provide that a tavern keeper is not allowed to serve alcohol to someone who is visibly intoxicated.
Witnesses reportedly said that Abad appeared to be inebriated while he was served alcoholic drinks, and was even given free alcoholic drinks, at both bars. Kudlac’s attorney is seeking damages for pain and suffering, as well as loss of enjoyment of life.
