On January 31, 2012, Mitchell Proner announced the details of a $460 million lawsuit filed on behalf of approximately six passengers who were aboard the Costa Concordia when it ran aground. The lawsuit was filed in conjunction with another US law firm in the Florida civil courts.
The Costa Concordia Disaster: Who Is Responsible?
The success of any personal injury lawsuit rests upon a number of factors, including, most fundamentally, the identification of the party or parties responsible for the accident resulting in the injury. In many cases, multiple parties share responsibility to varying degrees. It is the duty of the attorney pursuing the case to establish to which degree these parties are responsible and to demonstrate this responsibility in a court of law. When damages are awarded, the responsible parties are then ordered to contribute their fair share of monetary compensation to the injured victim or victims.
In the case of the Costa Concordia cruise ship accident, the ship's operator, Costa Cruise Lines, Inc., is placing sole blame for the wreck at the feet of the ship's captain, Francesco Schettino, who strayed from the ship's electronically charted course to "salute" the Italian island of Giglio. It is unlikely, however, that an accident of this proportion could be attributed to the actions of a single disobedient captain.
At present, Mitchell Proner is collecting evidence to prove that multiple parties are to blame, and therefore are financially liable, for the injuries and deaths that resulted from the Costa Concordia accident. "At this point we're exploring numerous defendants," Mr. Proner told international news agency AFP. He specifically named Costa Cruise Lines as a likely target of litigation.
It is also possible that legal action could be taken against Carnival Cruise Lines, the Miami-based owner of Costa Cruise Lines.
What Is a Class-Action Lawsuit?
The American justice system is designed to be as fair and efficient as possible, to the benefit of both plaintiffs and defendants. How, then, do the courts handle incidents in which hundreds or even thousands of people are injured by an act of negligence committed by a single party?
