Freedom Can’t Be Protected By a Helmet

If you were sitting where I was today, near the front of the basement courtroom in City Hall as the cop was testifying, you probably would have seen Mitch Proner's eyes light up the way I did.

Mitch Proner is a sharp Manhattan lawyer. He was in town to defend the ABATE 13. Those are the bikers ticketed on Central Avenue on the day of ABATE's huge annual rally on the Capitol steps. They were lobbying to get New York to drop its law requiring motorcyclists to wear helmets.

One of the cops who issued the tickets was testifying against Prospector, who'd led the group. Prospector is actually a burly, gray-bearded guy of 54 named Bob Boellner, who lives near Preston Hollow.

Prospector is a devoted member of ABATE. That stands for A Brotherhood Against Totalitarian Enactments. He figures that if he doesn't want to wear a helmet when he pilots his 22-year-old Harley, it's really none of the New York Legislature's business...

Begs for Kid Back in HRA Sex-Abuse Case

"At this point I am very scared for my 6-year-old daughter.” Desiree Rodriguez, a Bronx mother, tears streaming down her face, begged yesterday for the return of her 6-year-old daughter, allegedly now a victim of abuse by a city foster-care worker.

The client, 24, said she voluntarily turned custody of her three children, ages 2 to 6, over to the Human Resources Administration because she was “overwhelmed.”

Her neighbors complained of noise from her kids running around her apartment on Southern Boulevard, but she was worried about letting them play outside.

“I would not allow my children to play outside. Three times a week I heard gunfights,” she cried. “It's too dangerous outside.”

Hoping that the city could take better care of her children than she, Rodriguez gave them up to the HRA. But last Wednesday, houseparent Caryles Brown, 25, allegedly sodomized the little girl. An HRA field worker who had brought the girl to the center heard the girl's cries and called police after talking to her.

The mother was informed of the attack the next day when she was in Family Court to complete the legal transfer of the children. Brown was charged with aggravated sexual abuse and sodomy after he surrendered to the police at the 20th Precinct in Manhattan Friday. The woman's lawyer said the attack took place at the HRA's Laight Street “pre-placement center” in lower Manhattan while the child was being bathed in the evening.

“He [Brown] was allowed to bathe and wash this 6-year-old female unsupervised,” said attorney Mitchell Proner. “While this was going on, two supervisors were two floors up having a party.” Later on, Proner was told by the district attorney about the attack. Rodriguez is now demanding the return of her children and is pursuing a civil suit against the city. She said HRA refused to give her any information – or even tell her where her children were...

Three Killed in Fire - Blaze Sweeps Harlem Hotel: 33 Injured

Three people were killed and 33 others injured after a three-alarm fire – possibly started by burning incense – swept through a Harlem hotel early yesterday morning, authorities said. The names of the dead were not disclosed, although there were unconfirmed reports that all were women. Five of the injured people were reported in critical condition at four Manhattan hospitals last night, according to the Fire Department.

More than 175 firefighters from 35 units fought the flames that swept through the fourth and sixth floors of the building on 30 Hamilton Pl., said Fire Department spokesman Bob Leonard. The blaze broke out about 3:45 a.m. and was under control by 5:20 a.m., he said.

The cause of the blaze was still under investigation last night, Leonard said, despite police reports that a blind man was burning incense on a small dresser in his apartment on the fourth floor of the six-story Hamilton Hotel. After the dresser caught fire, the man attempted to douse the flames by pushing it into his bathtub, police said. He then shut the bathroom door and ran for help, said police spokeswoman Sara Carpenter.

Many residents were seen screaming for help from the windows of the fourth and sixth floors when firefighters arrived on the scene, Leonard said. One person jumped from a window but survived, he said.

“There was black, heavy smoke all over the place,” said Albert Strong, 50, who lived on the third floor with his wife. “We grabbed whatever clothes we could put on and ran to the stairway. Everybody was just running for their lives.”

Capt. John Bruckner of Ladder C, 23, a half-block away from the Hamilton Hotel, was one of the first firefighters on scene.

“The heat was just unbelievable,” Bruckner said. “Every door frame on the floor was burning. We found a woman in a wheelchair in the door frame of her apartment. She was just burned where she was,” he said. Bruckner said that the stairway doors on the fourth and sixth floors had been propped open, allowing the fire to skip the fifth floor. The stairway doors are supposed to be self-closing to prevent fires from spreading from floor to floor.

“People often open these doors for better ventilation,” Bruckner said. “They don't see the deadly consequences.

The owner of the building, Jacob Tepper, did not return several messages left at his office. A spokeswoman for the Department of Housing Preservation and Development said the building had four minor violations between 1990 and 1993, but none were related to fire safety.
