Types of Personal Injury Settlements

There are two types of personal injury settlements – structured and unstructured – each of which has its own advantages and disadvantages.  Our attorneys can help you choose the settlement type that will best meet your needs. 

Structured Settlements

A structured settlement provides the plaintiff regular payments over the course of several years, or for the rest of the plaintiff’s life.  The settlement (annuity) is typically paid by the defendant’s insurer.  This arrangement provides numerous benefits:  structured settlements are usually tax free, and they prevent the plaintiff from spending the entire settlement all at once.  A structured settlement can be tailored to meet the plaintiff’s unique needs; for example, it can be combined with a lump-sum payment to cover immediate expenses (medical bills, etc.).  Structured settlements also provide the security and peace of mind of dependable payments, and they are usually protected by state insurance laws if the defendant’s insurer goes bankrupt.

Unstructured Settlements

An unstructured settlement is paid to the plaintiff in one lump sum.  The plaintiff may then do with the settlement whatever he or she sees fit.  This arrangement has several advantages:  it assures that the defendant is made to pay the entire settlement, prevents disbursement of too-small annuity payments, and is typically not subject to dissolution.  However, most clients do not choose this option, since it does not offer protection from over- or unwise spending of the settlement monies.
