Helmet Laws

Massachusetts motorcycle accident statistics are clear: wearing a helmet is correlated with surviving a motorcycle accident and preventing wrongful death. State law includes a universal helmet law, which mandates that riders of all ages wear a helmet while riding. The universality of the law distinguishes Massachusetts from states that do not have helmet laws and from states that only require riders under a certain age to wear a helmet.

Other Pertinent Personal Injury Laws

State personal injury laws affect the filing of a motorcycle accident claim. Personal injury laws in Massachusetts include:

Statute of limitations – The time limit, or statute of limitations, for filing a motorcycle accident claim (or another type of personal injury lawsuit) is three years from the date of the accident. The time limit for filing a property damage claim (i.e. seeking compensation for damage to one’s motorcycle) is also three years, as is the limit for filing a product liability claim (i.e. seeking damages for a motorcycle accident injury caused by a product defect). After the statute of limitations passes, the victim may not seek damages or obtain a settlement.

Contributory negligence Massachusetts motorcycle accident law does not bar a victim who is partially responsible for his or her injuries (thus having contributory negligence) from obtaining damages (as long as the victim’s liability is not greater than the other liable party or parties). The law does, however, require that the victim’s settlement be in proportion to his or her degree of fault.
