Generally speaking, when someone acts negligently and that party’s negligence causes a motorcycle accident, the negligent party (the defendant) can be held liable for injuries caused by the accident. Motorcycle accident law includes a number of statutes that define who may be held liable for a motorcycle accident injury or death, who must pay damages to the victim (the plaintiff), the process of filing a lawsuit, and additional matters. Although every state has motorcycle accident laws, the particulars of those laws vary state to state. Therefore, it is essential that crash victims hire a practiced motorcycle accident attorney as soon as possible after the accident. A lawyer with experience navigating state motorcycle accident laws is best equipped to handle the victim’s potential claim.

Given motorcycles’ lack of crashworthiness, most motorcycle accident injuries are catastrophic – for example, back, burn, spinal cord, and brain injury, and even wrongful death. However, relatively minor injuries (such as road rash and broken bones) are also possible. Whatever the severity of the injury, victims may be entitled to damages and should seek legal counsel as soon as possible after the crash.
The size of a motorcycle accident settlement depends on a number of factors. For example, the severity of the injury, the cause of the accident, state motorcycle accident laws, and the skill of the victim’s lawyer will impact the damages the injured obtains. Hiring a skilled motorcycle accident attorney is the first step in maximizing the size of the settlement a plaintiff obtains.
Filing a motorcycle accident lawsuit is a complicated process of proving the fault of the defendant, seeking damages, and filing the proper documents within time limits established by state law. Given the complexity of filing suit, it is crucial that victims hire an attorney with experience handling motorcycle accident claims. Our attorneys have handled many claims in Maine, with exceptional results. If you or a loved one is in need of legal counsel after a crash, entrust your potential case to our team of experts.

The following motorcycle accident statistics underscore accident trends in Maine and throughout the nation since 1999*:
In 1999, there were 2,472 motorcycle accident fatalities – and an additional 50,000 injuries – in the U.S. This was a 2 percent increase in deaths and an 8 percent increase in injuries from the previous year.
Between 2004 and 2005, the number of motorcycle fatalities in the U.S. increased (from 432 in 2004 to 506 in 2006), as did the number of total motor vehicle fatalities (which increased from 194 in 2004 to 169 in 2005).
Of the 4,329 highway traffic fatalities in Maine in 2005, 34 percent (15 deaths) were motorcyclists. Of these victims, 40 percent were helmeted, eight had a Blood Alcohol Content (BAC) of .01 or higher, and seven had no BAC.
Of the 18 motorcycle accident fatality victims in Maine in 2007, 33 percent were helmeted at the time of the crash, 25 percent were riding with a BAC of .08 or higher, and 26 percent had a BAC of 0.01 or higher.
Maine is one of 16 states without a motorcycle advisory committee; 12 without a motorcycle safety plan; two without “sharing the road” information in its driving manual; three with mandatory rider education programs for all riders; and 27 with anti-impaired riding education programs for motorcyclists.
