Motorcycle accident law includes a number of statutes pertaining to the rights of those involved in a motorcycle collision, including the injured (the plaintiff) and the party responsible for the accident (the defendant). The law addresses matters including negligence, determining liability, proving the fault of the defendant, filing a claim within the state-mandated time frame (the statute of limitations), and compensating a victim’s injuries. While every state has motorcycle accident laws, the particulars of those laws vary state to state. Understanding the laws in one’s state is crucial in order to file a successful claim.

Generally speaking, since motorcycles offer no protection to riders in the event of a crash, motorcycle accident injuries tend to be catastrophic, including burn, spinal cord, back, and brain injury. Many crashes result in motorcycle accident death. The severity of the injury depends on a number of factors, including road and weather conditions, the speed at which the motorcyclist was riding, the object with which he collided, and whether or not he was wearing a helmet at the time of the accident.
When a motorcycle accident victim can prove that another party’s negligence caused the victim’s injuries, the victim may seek compensation for his injuries. The process of gathering evidence, proving fault, and seeking damages is the essence of a motorcycle accident lawsuit. It is highly advisable for victims to hire an attorney with experience handling motorcycle accident claims, since the process of filing suit can be overwhelming – and unsuccessful – without the guidance of a talented lawyer.
A motorcycle accident settlement includes compensation for the financial losses a motorcyclist suffers because of his injuries – for example, his medical expenses, lost wages, decreased earning potential, and the cost of maintaining his household during recovery. The settlement may also compensate the victim for his emotional losses – for example, his loss of enjoyment of life, pain, and emotional suffering.
