About Connecticut Motorcycle Accident Laws

Every motorcycle accident victim should be aware of the laws impacting his potential case. Only by understanding the law – and securing the services of an experienced attorney – can an injured motorcyclist obtain the damages to which he is entitled. At Proner & Proner, our motorcycle accident lawyers are well-versed in Connecticut motorcycle laws. Our goal is to help clients become fully informed of their rights and to obtain the best possible results, thereby providing the caliber of legal representation for which our firm is known.

Motorcycle Accident Laws Impacting Connecticut Claims

When a motorcyclist sustains a motorcycle accident injury that is caused, at least in part, by another party’s actions or negligence, the motorcyclist may be able to seek financial compensation for his injuries. Proving the fault of the negligent party is the crux of a motorcycle accident claim and the basis for obtaining damages. Accordingly, there are a number of motorcycle accident laws governing the process of proving fault, including personal injury, negligence, and liability laws. Depending on the circumstances of the accident, the severity of the victim’s injuries, state motorcycle accident law, and the skill of the victim’s lawyer, the victim may be able to obtain compensation for his injuries, pain, and suffering.

If you or a loved one has sustained an injury in a motorcycle collision, contact Proner & Proner to schedule a free case evaluation with one of our motorcycle accident lawyers. We are known among Connecticut law firms for obtaining exceptional results.

State Motorcycle Accident Laws

Connecticut motorcycle accident law includes a number of statutes related to personal injury, helmet usage, and additional matters, including:

Helmet Laws

The state of Connecticut requires motorcyclists under the age of 18 to wear a helmet while operating a motorcycle. (The age limit distinguishes Connecticut from states that require all motorcyclists to wear a helmet and from those that do not require helmet usage at all.) Connecticut motorcycle accident statistics suggest that mandating helmet usage is beneficial for motorcyclists, since the statistics underscore the role of wearing a helmet in reducing the risk of catastrophic injury in a crash.

Other Pertinent Personal Injury Laws

There are a number of personal injury laws in Connecticut that can impact a motorcycle accident claim. These include:

Statute of limitations – State law requires that plaintiffs seeking to file a civil personal injury claim do so within three years of the injury. This time limit is the statute of limitations. The statute of limitations for filing a property damage claim (e.g. compensation for damage to one’s motorcycle) is two to three years, depending on the particulars of the case. The statute of limitations for filing a product liability claim is two years.

Comparative negligence Connecticut maintains a modified comparative negligence law. When the victim is partially responsible for his injuries, this does not necessarily bar him from obtaining damages, as long as his negligence is not greater than the combined negligence of the defendant or defendants. However, the size of his settlement is decreased in proportion to his degree of negligence.

Contribution among tortfeasors – Under the doctrine of “contribution among tortfeasors [liable parties]”, a defendant who is made to pay damages in excess of his degree of fault may sue the other defendant(s) for repayment of the excess amount.
