Proving Liability in a Case Involving a Car-Emergency Vehicle Acciden

Proving liability in cases involving an accident between a car and an emergency vehicle can be complicated.  While motorists are required to yield to oncoming emergency vehicles (if those vehicles announce their approach with siren and sound), motorists’ failure to yield does not guarantee they will be held responsible for an accident. Rather, the circumstances surrounding the accident will largely determine liability.  For example, if the driver of an emergency vehicle fails to give sufficient warning of the vehicle’s approach and an accident results, the emergency vehicle driver could be held liable.  Alternatively, if a car and an emergency vehicle collide due to defective traffic flow monitoring devices, the city (or the party responsible for maintaining those devices) can be held liable.  Finally, the law does not condone over-aggressive driving by emergency vehicle drivers.  Although these drivers are authorized to drive assertively and to exceed the speed limit in certain circumstances, they must remain within certain parameters.  When emergency vehicle drivers fail to stay within these parameters and an accident or injury ensues, the emergency vehicle driver can be held liable.
