Accident Investigation and Reconstruction - Car Accident Lawyers and Lawsuits in New York City

The experienced attorneys of Proner & Proner are some of the premier car accident lawyers in New York, bringing successful car accident lawsuits on behalf of clients in New York City and elsewhere. What sets us apart is our expertise in conducting thorough investigations of car accidents, and reconstructing the accident with the help of qualified engineers. These investigations give us the evidence we need to show a jury what really happened during the accident, and who was at fault. This translates to higher monetary settlements for you.

Why Is Accident Investigation Important?

For two generations, our car accident lawyers based in New York City have been representing plaintiffs seeking monetary awards after a car accident. By helping our clients file car accident lawsuits and providing them with expert representation, our lawyers have been successful in getting our clients the compensation they deserve for property damage, past medical expenses, future medical expenses, past lost earnings, future lost earnings, loss of earning capacity, loss of enjoyment or quality of life, and pain and suffering.

We do this by determining the cause of the accident – whether it be unsafe roads, defective vehicles, or careless drivers – and hold the responsible party or parties liable for damages. We’ve learned through experience that a thorough investigation of a car accident is the key to getting the most money as quickly as possible for our clients.

Early investigation by our experienced investigators allows us to preserve evidence that may be needed to obtain the best possible results for our clients. There is no list that can include all the evidence that an experienced investigative team can uncover. The investigative team includes seasoned investigators, paralegals, our car accident lawyers, and when necessary, accident reconstruction engineers. Usually, their investigative process begins with surveying accident scenes.

What Investigative Teams Look For

Our investigative team draws on their training and experience to scour the scene of a car accident for any information that may be helpful to our clients.

When helpful, our team takes photographs, measurements, and video tape footage from all lines of vision (sight lines). These steps are repeated for all perspectives that the individuals involved in and witnesses to the accident had immediately prior to, during, and subsequent to an accident. Also, there are often surveillance videos that capture incidents as they unfold.

Sometimes there is evidence of skid marks and "yaw" marks (lateral movement by tires) at the scene of an accident. These tires can be examined, measured, and preserved with photographs from angles where they can be used to show speed or attempts at evasive maneuvering prior to impact and at the point of impact. On occasion, accident debris is left behind that can place a point of magnitude of impact. Even when this debris is removed by people who arrive at the scene of the accident, such as law enforcement agents or tow truck operators, sometimes something is left behind to help prove our clients' cases.

The evidence obtained in our investigation is reviewed immediately by the car accident lawyers in our New York City office. If necessary, we will have engineers review the evidence for proof of roadway design defects, roadway maintenance defects, improper signs, poorly marked construction, failure to provide adequate warnings of construction, and any other significant factors that cause car accidents.

Our investigators also look to get witness statements immediately, since witness recollection may change over time. We don't want the lawyers representing insurance carriers and corporate and municipal defendants to have access to earlier and better witness statements than the ones we are using to help our clients.

Accident Reconstruction

When all the available evidence is gathered and preserved by our skilled investigative teams, we review it and decide whether accident reconstruction is necessary to protect our client's interests.

Accident reconstruction can be the key to achieving just compensation in car accident lawsuits. Our lawyers in New York City will first determine if reconstruction of the accident is necessary in your case. If a case involves a simple rear end collision with no other contributing factors, it is not in your best interest to spend thousands of dollars to have engineers review the data. On the other hand, in accidents involving vehicle rollover, seatbelt failure, or other factors that may result in catastrophic injuries or death, we work with skilled engineers to reconstruct an accident and build a strong case.

Many computer models are available to the accident reconstruction professionals that determine – within reasonable degrees of engineering certainty – velocity and changes in velocity. This helps to establish all the contributing factors in the cause of and ultimately the legal responsibility for an accident. The engineers also look at roadway design, roadway signs, and compliance with statutes for commercial vehicles, passenger vehicles, and emergency vehicles. They look at angles of vision, angles of impact, and post-accident momentum angles.

When a member of a jury sees a good engineer testify, he or she knows that engineer has better knowledge than anyone else of how and why an accident occurred. The car accident lawyers at New York City–based Proner & Proner are experts at locating knowledgeable engineers who can provide compelling testimony in the courtroom.
