Motorcycle Accident Attorneys Alabama

Alabama Motorcycle Accident Laws and Statistics

According to the National Highway Traffic Safety Association, per vehicle mile traveled, motorcyclists are approximately 35 times more likely than other motorists to die in a traffic accident. Such motorcycle accident statistics are particularly important for Alabama motorcyclists for a number of reasons, including the fact that the state does not have a specific motorcycle safety plan. Motorcyclists therefore potentially face a heightened risk of serious personal injury and death.

At Proner & Proner, our experienced motorcycle accident attorneys represent victims throughout Alabama and the nation. We have years of experience representing injured motorcyclists and a track record of bringing cases to successful resolutions. We will work diligently to protect your rights and obtain the full measure of compensation to which you are entitled.

Motorcycle Accident Law

According to our motorcycle accident attorneys serving Alabama, injury law is designed to protect the rights of motorcyclists injured due to another party’s negligence. When the motorcyclist can prove the other party’s full or partial responsibility for the accident, the motorcyclist may be able to obtain a motorcycle accident settlement or jury award. Depending on the cause of the motorcycle accident, a number of parties (including motorcycle designers and manufacturers, other motorists, and those responsible for maintaining safe road conditions) may be found liable for a motorcycle accident.

Types of Injuries

The severity of a motorcycle accident injury largely depends on the circumstances surrounding the accident, including the speed that the motorcycle (and the other vehicle, if applicable) was traveling, road and weather conditions, and whether the motorcyclist was wearing a helmet. A motorcyclist’s injuries may be relatively minor (e.g., broken bones, minor concussion, or road rash), although all too often they are catastrophic (e.g., burn, back, spinal cord, or brain injury). A motorcycle accident is more likely to cause wrongful death than a motor vehicle accident, since motorcycles do not protect riders in a crash.

Filing a Motorcycle Accident Lawsuit

In order to obtain compensation in a motorcycle accident lawsuit, victims must be able to prove the fault of the other party or parties. Given the complex nature of personal injury and motorcycle accident law, insurance issues in a motorcycle accident, and other factors, it is essential that victims hire a talented lawyer with experience handling motorcycle accident claims. Only an attorney who has a history of successfully litigating motorcycle injury cases has the in-depth understanding of the laws necessary to bringing your case to a successful resolution.

Motorcycle Accident Statistics

The following motorcycle accident statistics for the state of Alabama and the nation highlight accident trends over the past decade*:

In 1999, of Alabama’s 1,138 traffic fatalities, 32 (3 percent) were motorcyclists. The previous year, there were seven motorcyclist fatalities per 10,000 registered motorcycles, with 44,000 motorcycles registered that year.

Of the 1,131 highway traffic fatalities in Alabama in 2006, 34 percent (382) involved a blood alcohol concentration (BAC) of 0.08 or higher. Of these fatalities, 61 were motorcyclists, 95 percent of whom were helmeted, 18 percent of whom had a BAC of .01 or higher, and 43 percent of whom had no BAC.

In 2007, 80 motorcyclists were killed in Alabama, 91 percent of whom were wearing helmets, 19 percent of whom were operating while intoxicated, and 25 percent of whom had a BAC of 0.01 or higher.

Alabama is one of only six states without a Sharing the Road program, one of nine states whose Strategic Highway Safety Plan doesn’t address motorcyclist safety, and one of 16 states without a motorcycle advisory committee.
